1. Name: The name of society shall be “Bharat Vikas
Parishad”
2. Regd. Office : The registered office of the Bharat Vikas Parishad shall be at Delhi.
Part - II

3. Aims & Objects
The principal object of the Parishad shall be to strive for the development and growth of Bharat, in all fields of human endeavor, and without prejudice to the generality of that object, the Parishad shall, in particular subject to its capacity and resources, engage in the pursuit of the following objects:
(a) To adopt appropriate ways and means for the cultural, social, academic, moral, national and spiritual progress of our country;
(b) To promote dance, drama, music, literature, humanities and social sciences based on Bharatiya Culture and traditions;
(c) To inculcate profound and pervasive sense of patriotism and deep commitment to National Integration and unity among the people of
Bharat;
(d)To commemorate Bharat’s many splendoured contributions to humanitarian and aesthetic values and to advance the frontiers of awareness in pursuit of the Truth, the Good and the Beautiful
(Satyam, Shivam, Sundaram);
(e) To foster tolerance and understanding among all sections of the society;
(f) To preserve, promote and secure Justice, Liberty, Freedom, Fraternity and Equality so that Democracy and Rule of Law, in true sense, may become the warp and woof of our national life and Human Dignity, Social Justice and Fundamental Rights may become a living reality;
(g) To organise meetings, seminars, symposia, lectures, discourses, conferences, discussion groups, training courses, exchange programmes, exhibitions and festivals;
(h) To organise courses and camps for social services and social development;
(i) To observe anniversaries of Bharat’s Great Men and commemorate and celebrate landmark events and occasions;
(j) To establish museums and collections of memorabila;
(k) To undertake programmes and activities for rural reconstruction and urban rehabilitation and for the improvement of life at all levels;
(l) To establish and manage or collaborate in establishing and managing educational institutions and to raise funds generally for such purposes and especially for the socially, economically or physically handicapped;
(m) To raise and receive funds, donations, subscriptions, gifts or other
considerations; to borrow money; to accept deposits, to invest or donate for the purchase of objects of the organisation, to pay out of
the funds of the Parishad all its expenses and expenses
incidental to raising of money or to repay any money borrowed
and to redeem its properties.
(n) To take on lease or to accept as gift or otherwise
acquire any land or building which may be necessary or
convenient for the purposes of the Parishad.
(o) To purchase or construct any building structure or
property for the benefit of the Parishad.
(p) To sell, gift, license, give or take on lease or on
hire, exchange with or without any consideration all
properties of the Parishad to or from any other institution,
person or persons for the benefits of Parishad or for the
advancement of its objects;
(q) To draw, accept, make and endorse promissory notes,
bills and other negotiable instruments etc;
(r) To use, employ and invest moneys in securities and
other permissible investments, etc;
(s) To compensate, re-imburse or remunerate any person,
body or company for service rendered to or expenses incurred
for the Parishad or on its behalf;
(t) To execute such agreements, conveyances, transfers,
leases, licences, mortgages and any other documents as may be
considered necessary to carry out the objects of the
Parishad.
(u) To do within the framework of the objects all such
other things as may be directly or indirectly conducive or
incidental to the attainment or advancement of the aforesaid
objects or any one of them provided that the income and
properties of the organisation shall be applied solely towards
the promotion of the objects of the Parishad; and
(v)
Money received in excess of expenditure will be utilized as
per provisions of the Income Tax Act.

Members
Following shall be the categories of members:
(A) Ordinary Members
(i) Any person interested in the objects and activities of the Parishad may be enrolled as an ordinary Member of the Parishad subject to the approval of the Branch Executive to which he wishes to belong but subject to advance payment of admission fee of minimum Rs.100/- along with annual subscription as may be prescribed by the executive committee of the branch from time to time or in specific cases by Prant or National Executive.
Provided that any further enhancement in annual subscription may be made only by approval by 2/3rd majority of members present at a specially convened meeting of General Body of the branch.
(ii) A member who defaults in the payment of annual subscription shall not be entitled to continue either as an office bearer at any level or vote in any election or meeting.
Provided that he will be entitled to exercise all the rights on or after the date of payment of arrears to the Branch.
(iii) The Husband/Wife of the member shall also be deemed to be a member with all the rights, including the right to vote and seek election, but for the purpose of counting membership of a Branch, both will be counted as one unit.
Provided that in the elections of the Branch only one of the two may contest election.
(B) Honorary Members
The executive of a Branch may co-opt any person whom it wishes to honour for his interest in the objects and activities of the Parishad as an Honorary Member on such terms as it may consider appropriate.
Provided that an Honorary Member shall not be entitled to vote or seek any election at any level.
5. Patrons
(a) Any distinguished person who is or is likely to be interested in the activities of the Parishad may be nominated as Patron or Chief Patron by the Apex Body at National Level for such period as it may consider appropriate. A Patron shall not be entitled to vote or to seek any election.
(b) On similar grounds, Chief Patron or Patrons not more than three in number may be nominated for each Prant by the Apex Body on the recommendation of the Executive Committee of the Prant concerned. Likewise, Chief Patron or Patrons not more than three may also be nominated for each branch by the Prant Executive on the recommendations of the Executive Committee of the Branch concerned.
6. Rights and Privileges of Members
Subject to the provisions of the rules of the Parishad, a member shall have the following rights:
(a) to vote on any proposal concerning the Parishad which may be placed for consideration in a general or special meeting of the General Body of the Branch to which he belongs; and
(b) to elect or to be elected as member of the Executive or any other Committee or Sub-committee constituted to regulate and help in the activities of the branch or the area to which he belongs;
(c) to participate in any meeting or gathering arranged by its Branch, Prant or Centre for its members generally.
7. Duties of a member towards Parishad
Every member of the Parishad shall have the following duties towards Parishad:
i) He must participate in the programmes arranged by the Branch and also attend the maximum number of meetings as far as possible;
ii) He must observe the decorum and maintain discipline in the programmes and meetings of the Parishad;
iii) He must pay the annual subscription of the branch well in time but not later than the last date prescribed by the Branch; and
iv) He must not do any such act, which may tarnish the image of the Parishad in the society.
8. Termination of Membership
Membership may be terminated:
i) By resignation; or
ii) Owing to default in payment of annual subscription after expiry of the last date as prescribed by the Branch Executive; or
iii) Owing to misconduct, mental incapacity or moral turpitude;
Provided that in cases under clauses (ii) & (iii), a show cause notice has to be served and opportunity of being heard has to be given to the member affected.
Explanation -
The membership under clause (iii) may be terminated by Branch Executive or Prant Executive Committee or Apex Body as the case may be.
Part-IV

Organisational Structure
9. The organisational structure of the Parishad shall consist of the Branch at primary level and the Centre at the top. In between these two set-ups, there shall be Prant and Zone.
A) National Level
i) There shall be a supreme body of the Parishad called National Council.
ii) There shall be a governing body called National Governing Board.
iii) There shall be a National Executive.
iv) There shall be an Apex Body.
B) Zonal Level
i) There shall be a Zonal Council.
ii) There shall be a Zonal Executive.
C) Prant Level
i) There shall be a Prantiya Council.
ii) There shall be a Prant Executive.
D) Branch Level
i) There shall be a General Body of the Branch with all its members as mentioned at Article-4A(i) & 4 A(iii).
ii) There shall be a Executive Committee of the Branch.

Branch Level Set-up
10. Establishment of Branch
i) A Branch may be established for any specified city or town or for a specified area within a city or town. Its title shall be Bharat Vikas Parishad (name of the place or area).
ii) The minimum number of members necessary for establishment of a Branch shall be 25.
iii) The Branch shall receive Affiliation Certificate under the authority of the Apex Body and function generally
under the direction and supervision of Prantiya Parishad and Prantiya Executive.
11. City Co-ordination Committee - At places where there are more than one Branch in a city or town, there shall be a Co-ordination Committee comprising of Presidents, Secretaries & Treasurers of all the branches in the city or town. It will be discretionary for the Co-ordination Committee to co-opt other members of the local branches in the Committee. All the members of the Co-ordination Committee shall, by consensus, appoint a Co-ordinator who will be responsible for conducting the meeting of the Co-ordination Committee as and when necessary.
12. Office Bearers of the Branch
The election of the three office bearers namely President, Secretary & Treasurer shall take place in the general meeting as per election rules and procedure laid down in the bye-laws of the Parishad. These elected office bearers shall jointly nominate the Executive of the Branch as prescribed in the bye-laws.
13. Branch Executive
The Executive constituted as above shall have all the powers of General Body of the Branch and shall function for and on behalf of Branch subject to such directions as may be given by the Prantiya Executive and the Central Office of the Parishad.
14. Meeting of Branch Executive
The meeting of the Branch Executive shall be convened by the Secretary with the consent of the President as often as may be necessary by giving one week’s notice in writing by post or otherwise.
Provided however, that in case of urgency, the period of notice may be curtailed with the permission of the President of the Branch.
Provided further, that in case of emergency, the President shall be empowered to call a meeting of the Executive or General Body of the Branch.
Provided further, that the branch will hold each month at least one Executive Committee meeting and one General Body meeting or a programme as far as possible in pursuit of the objects of the Parishad.
The quorum for the meeting of the Executive shall be one fourth of its strength subject to minimum five whichever is higher. Provided that there must be atleast one member present other than the office bearers.
15. Annual Meeting of Branch
The annual meeting of General Body of Branch shall be held in the month of March/April every year, for which 10 days’ notice shall be given to all the members by the Secretary.
The following business shall ordinarily be transacted in this annual meeting:
i) Consideration and adoption of the Annual report and passing of the Annual Accounts for the year under report.
ii) Consideration of the Resolution/Resolutions moved by Executive or by any member of General Body, the notice of which should be given at least a week before the date of the meeting.
iii) Appointment of an Auditor for the ensuing year. The term of the office of the Auditor shall be for one year.
iv) Dayitva Grahan by the newly elected office bearers.
v) Speech by the outgoing President.
vi) Speech by the incoming President.
vii) Any other matter with the permission of the Chair.
Part-VI

Prant Level Set-up
16. Prant :- The Apex Body shall be empowered to form appropriate Prant unit of the Parishad and shall allocate branches to various Prants.
17. Prantiya Council
i) Each Prant so formed by the Apex Body shall have a Prantiya Council consisting of Presidents, Secretaries and the Treasurers of all the Branches of the Prant and all the members of the Prantiya Executive.
ii) If the membership of a Branch exceeds 50, the Executive of the Branch shall be entitled to nominate one delegate for every additional membership of 50 or part thereof in addition to its President, Secretary & Treasurer to the Prantiya Council.
Explanation - The Prantiya Council so constituted shall also be Electoral College for the purpose of election of Prantiya office bearers.
18. Prantiya Executive
The Prantiya Council or the Electoral College of the Prant, shall elect three office bearers namely, President, General Secretary and the Treasurer in accordance with the Election Rules and Procedures laid down in bye-laws of the
Parishad.
These three elected office bearers will jointly nominate Prantiya Executive according to bye - laws.
19. Members of Prantiya Executive
It shall consist of the following:
i) Elected office bearers of the Prant.
ii) Nominated office bearers and the Project Conveners of the
Prant.
iii) Regional / District office bearers, if any.
iv) All members of National & Zonal Executive, who are the members in any branch of that Prant, as ex-officio members.
20. Powers of Prantiya Executive
The Prantiya Executive shall be responsible for opening of new branches in the Prant and plan further expansion of the Parishad activities and at the same time it shall also monitor the working and functioning of the existing branches and the newly opened branches. The executive will also execute the programmes and projects as given by the Centre and also abide by the directions as given by the Centre in respect of general and specific functioning of the branches in the Prant.
21. Prantiya Organising Secretary
i) The Apex Body of the Parishad may appoint Organising Secretary for any Prant on its recommendation for the purpose of establishing new branches or for looking after the organisational matters of branches of the Prant after their establishment. The term of Organising Secretary will be for one year from the date of its appointment.
ii) The Organising Secretary shall function under the guidance of Prant President and General Secretary. However, it would be subject to and in conformity with the guidelines issued by the National Governing Board or the Apex Body.
22. Meetings of the Prantiya Council & Prantiya Executive:-
There shall be minimum two meetings of the Prantiya Council and minimum two meetings of the Prantiya Executive every year.

Zonal Level Set-up
23. Zones: The Apex Body shall be empowered to form appropriate Zone comprising of several Prants
24. Zonal Council: It shall consist of the following:
(i) All the members of Zonal Executive
(ii) Presidents, General Secretaries, Treasurers and Organizing Secretary (if any) of the Prants within the Zone.
(iii) All the members of National Executive who are the members in any branch in the Zone
25. Zonal Executive: It shall consist of the following:
(i) Zonal Chairman
(ii) Zonal Secretary
(iii) All Zonal Conveners
26. Meetings of the Zonal Council & Zonal Executive: There shall be minimum two meetings of the Zonal Council and minimum two meetings of the Zonal Executive every year.
Part-VIII

National Level Set-up
27. National Council
There shall be National Council at the Centre. All powers of the Parishad shall vest in the National Council. The National Governing Board, National Executive and the Apex Body shall be answerable to the National Council, which shall be the Supreme Body of the Parishad.
28. Composition of National Council
The National Council shall consist of the following:
i) Presidents and Secretaries of all the branches;
ii) Presidents, General Secretaries, Treasurers and Organising Secretaries of all the Prants;
iii) All members of Zonal Executives;
iv) All members of National Executive.
29. National Office Bearers
Following shall be the National Office bearers of the Parishad :
i) National President
ii) National Working President
iii) National Vice-Presidents
iv) National Secretary General
v) National Finance Secretary
vi) National Organising Secretary
vii) National Additional Secretary Generals
viii) National Chairmen
ix) National Secretaries
30. National Governing Board
It shall consist of the following:
i) All members of the National Executive.
ii) All members of the Zonal Executives.
iii) Presidents of the Prants having 6 or more branches.
iv) General Secretaries of all Prants.
v) Treasurers of the Prants having 25 or more branches.
vi) Organising Secretaries of the Prants having more than 50 branches.
vii) Members nominated by the Apex Body.
31. Powers of National Governing Board
A) National Governing Board shall have all powers of the National Council.
Provided, however, that the National Council may by resolution give directions or make recommendations to the National Governing Board on any matter concerning the affairs of the organisation.
B) Following office bearers shall be elected by the National Governing Board:
(i) National President
(ii) National Working President
(iii) National Secretary General
(iv) National Finance Secretary
Provided that these elected office bearers shall jointly nominate the National Executive according to bye-laws.
32. Meetings of National Executive & National Governing Board
The meetings of the National Executive and
National Governing Board shall ordinarily be convened by the Secretary General with
the consent of the National President at least once in a year by giving a fortnight’s notice in writing by post or otherwise. But in case of emergency, the meeting may be called at any time, and even at a shorter notice, with the previous permission of the National President.
33. National Executive
Following shall be the members of the National Executive:
i) National President
ii) National Working President
iii) National Vice-Presidents
iv) National Secretary General
v) National Finance Secretary
vi) National Organising Secretary
vii) National Additional Secretary Generals
viii) National Additional Organizing Secretary
ix) National Chairmen/Vice Chairmen of all Committees
x) National Secretaries
xi) National Conveners
xii) Editors
34. Power of National Executive
National Executive so constituted shall have all supervisory, financial and administrative powers of Parishad, subject to overall control of National Governing Board.
35. Apex Body
There shall be an Apex Body of the Parishad comprising of:
i) National President
ii) National Working President
iii) National Secretary General
iv) National Finance Secretary
vii) National Organising Secretary
vii) National Additional Secretary Generals
36. Powers & Functions of Apex Body
1. The Apex Body shall have the following powers:
i) To take decision on urgent matters in the interest of the Parishad.
ii) To constitute various National Committees and to fix their terms and conditions and to implement their recommendations with or without modification.
iii) To make appointments to all Zonal Executives.
iv) To create new posts and make appointments for such posts in the interest of the working of the Parishad.
v) To nominate eminent persons of the Parishad as members of National
Governing Board not exceeding 7 and also special invitees.
2. Every decision of the Apex Body shall be presented for approval in the meeting of the National Executive or National Governing Board, whichever is held earlier.
37. National Council Meeting & National Conference
National Council Meeting and National Conference shall be held every alternate year, for which one-month’s notice shall be given to all the members by the National Secretary General.
38. Business to be transacted in National Conference
(i) Consideration and adoption of Secretary General’s report.
(ii) Reporting by the Prantiya General Secretaries about progress of the Prant.
(iii) Reporting by the National Conveners about the various National Projects.
(iv) Consideration of the resolution moved by or on behalf of the National Governing Board or by members of the National Council with the permission of the Chair. The notice of the such resolution should be given by the member to the Secretary General 15 days before the meeting.
(v) Speech by the National President.
vi) Any other matter with the permission of the Chair.
Provided that the order of proceedings or the Agenda for such Conferences shall be prepared by the Secretary General in consultation with the National President.
Part- IX

Miscellaneous
39. Bye-laws of the Parishad
The Apex Body shall have power to frame appropriate byelaws of the Parishad providing for the following among other matters:
i) Share of subscription payable by local branch to the Prant and the Centre.
ii) Nature and amount of grants and subscriptions which may be given by the Apex Body to the Prant units, local branches and affiliated
organisations.
iii) Elections Rules, Regulations and Procedure for conducting of elections at various levels.
iv) To prescribe duties, powers and functions of the office bearers at various levels.
v) To frame rules to bring uniformity in the working of the Parishad at all levels.
(vi) To formulate procedure for termination of membership.
(vii) To formulate procedure for removal of any office bearer.
(viii) To formulate procedure for filling up casual vacancies.
ix) Any other matter for efficient functioning and funding of the organization.
40. Affiliation of other organisations with Parishad
The Parishad may affiliate any other organisations with similar aims and objects working in India or abroad. Provided that they shall have to pay an affiliation fee of Rs. 150/- and a minimum of Rs. 150/- per member per year. They shall be treated as branch of the Parishad and shall have the same rights and privileges as enjoyed by its own branches. All powers for providing affiliation shall vest in the Apex Body.
Provided further, that the branches outside Bharat will be run under the name of “Bharat Vikas Parishad International”
41. Decisions by Majority
All decisions at all levels shall be taken by majority votes.
Provided however, that in the event of equality of votes on any question, the President or the Chairman of the Meeting shall have a casting vote.
42. Quorum: Quorum for the meetings of all Bodies of the Parishad at all levels shall be one-fourth of the total strength of concerned Body.
Provided that no quorum shall be required for a meeting adjourned for want of quorum but its fresh notice of 10 days will have to be issued to all concerned
43. Official Year & Subscription
Official year of the Parishad shall be the financial year i.e. from 1st April to 31st March. The subscription at the prescribed rate shall be paid in advance for a year on that basis.
44. Annual Accounts & Audit
(i) The accounts at all levels shall be prepared and maintained regularly under the supervision and guidance of the appropriate Office Bearers and shall be audited by the auditors as appointed by the concerned Executive.
(ii) The audited accounts of every Body shall be presented for consideration and approval in the meeting of General Body / Council / National Governing Board, as the case may be.
(iii) The accounts so approved shall be submitted to next higher Body within the time as may be prescribed.
(iv) Any Office Bearer, who fails to submit the accounts, shall be liable for appropriate action as may be prescribed from time to time.
45. Sub-Committees
The respective Executive Committees in their own sphere may appoint sub-committees for any special work or project of the Organisation, which it undertakes from time to time. The size, period and other terms of the sub-committees will be determined by the concerned Executive Committee.
46. Special General Body Meeting
Special meeting of the General Body may be called by the concerned Executive Committee for discussing any urgent or important matter concerning the Parishad.
A meeting of the General Body may also be convened at the written request of the one fourth (1/4) members of the General Body.
47. Bankers
The Bankers of the Branch shall be as may be approved by the concerned General Body. All money belonging to the Parishad
shall be deposited into its account with the bank or banks and no amount shall be withdrawn except on the authority of the person authorised to operate the accounts. The account of the Branch of the Parishad shall be opened under the authority of the President, Secretary (Convener in the case of an Adhoc Committee) and Treasurer and will be operated upon by the Treasurer and any one of the two other office bearers.
48. Removal of an Office bearer from any office
A person may be removed by concerned Executive from any office to which he was elected or nominated for good and sufficient reasons as under:
i) any conduct or behavior unbecoming of an Office bearer of the Parishad;
ii) any act of indiscipline;
iii) any conduct which has led to his conviction involving moral turpitude;
iv) committing of any financial irregularity.
49. Arbitration
If any dispute arises between a member or past member and the Parishad or any of its office bearers, that shall be referred to an arbitrator appointed by the Apex Body. The decision of the arbitrator shall be final unless it is modified by the Apex Body.
50. Finality of Decisions
(i) All the decisions of any committee at all levels shall be final and binding upon all concerned members.
(ii) The aggrieved member may file an appeal to next higher-level authority within one month, who shall decide the same within one month and this decision shall not be called in question in any court of law.
51. Disqualifications for being an office bearer
No member shall be eligible to be elected or nominated as an office bearer at any level under any of the following circumstances:
(i) If he has been convicted for an offence involving moral turpitude.
(ii) If he is an office bearer of a political party
(iii) If he is addicted to any intoxication
(iv) If he is guilty of “not handing over charge or not rendering accounts” as an office bearer at any level at any time.
(v) If he has been found guilty of committing financial irregularities at any level at any time.
(vi) If he is in arrears of membership subscription or any other dues / charges
(vii) If he has attained the age of 75 years, except advisory posts.
(viii) If he does not hold such other qualifications as may be prescribed in the bye-laws from time to time.
52. Supersession of Executive of any Branch or the Prant
a) As regards local branch, if in the opinion of the Prantiya Executive, if any branch of the Prant is not functioning in accordance with the constitution and the bye-laws and in the manner and discipline with which it is expected to work, it may, with its findings, send its recommendations to the Central Office for supersession of the Executive Committee of the said Branch and for appointment of an Administrator / Adhoc Body for such time as it considers necessary or until a duly elected body takes over.
b) As regards Prantiya Executive, the Apex Body shall have power to supersede the Executive of the Prant if it is of the opinion (on the basis of information received from any of its National office bearers) that it is not functioning in accordance with the constitution and the bye-laws or in the manner and discipline with which it is expected to work after giving an opportunity to the Prant of being heard in such manner as it thinks fit.
c) On the supersession of the Executive Committee of the Prant, the Apex body shall have the power to appoint Administrator / Adhoc Body for the said Prant/Unit for such time as it considers necessary or until the fresh duly elected body takes over which must take place as early as possible. The Administrator and the Adhoc Body so appointed shall have all the powers of the Prantiya Executive till the time it remains in the office.
53. Suppression of other bodies / Committees
If any body or committee of the Parishad does not function in accordance with the Constitution and bye-laws or fails to discharge its duties, the Apex Body may supersede the said Body or the committee and make suitable arrangements.
54. Appointment of Disciplinary Committee
The Apex Body shall appoint a Disciplinary Committee at the National level for a period of one year which may be extended further for one more year on the terms and conditions for its working and functioning as it considers necessary.
55. Parishad Activities in Villages
a) With a view to spread the activities of the Parishad at places covered by Village Panchayats, a Village Committee of the Parishad may be established with a minimum number of 11 members. The annual subscription per member shall be Rs. 100/- per year.
b) The annual Central share shall be only Rs. 100/- and the Prant share shall also be Rs. 100/- irrespective of strength of membership in the Committee. Only one copy of the 'Niti' magazine shall be supplied to the Committee by the
Centre.
c) As regards office bearers in the Committee there shall be one President and one Secretary-cum-Treasurer who shall be duly elected in the General Body meeting of the Committee.
d) The President and Secretary-cum-Treasurer shall represent the Village Committee in the Prant Council meeting as ex-officio members and they shall not be entitled to vote or to seek any election in the Prant.
56. Bharat Vikas Parishad Charitable Trust, New Delhi
The following shall be the trustees of Bharat Vikas Parishad Charitable Trust, New Delhi (Regd.) by virtue of office besides the founder trustees:
i) National Secretary General
ii) National Finance Secretary
iii) National Additional Secretary Generals
All these shall be trustees for a period of two years. Secretary General shall be the Chairman of the Trust. National Secretary Finance shall be the Treasurer of the Trust and any Trustee nominated by the Chairman shall be the Secretary of the Trust.
57. Controls Over Trusts
i) All trusts established at any level in the name of Bharat Vikas Parishad shall be subject to the overall control of the National Executive in general and in particular:
a) To ensure proper management;
b) To ensure proper maintenance of accounts and audit;
ii) The National Executive shall nominate two representatives of the Centre in each Trust as the representative of the Centre.
58. No local Branch or Prant of Bharat Vikas Parishad shall create or form any Charitable Trust or other organization to acquire any immovable property, unless the necessary permission is sought for and granted in writing by the Centre. Conditions may be imposed at the time of granting such permission and the same shall be binding.
59. Any Charitable Body/Trust/Society already formed for or on behalf of Bharat Vikas Parishad shall have to seek approval of the Centre for its continuance and shall function in accordance with and subject to such conditions as may be specified by the Centre
which shall be incorporated in the rules and regulations of
the trust or the body concerned.
60. Every Charitable Body / Trust / Society, whatever be
its name shall state "A body affiliated to Bharat Vikas
Parishad" on all documents such as letter heads, receipt
books, name plates, books, registers etc.
61. Term of Office Bearers at all levels
The term of elected National office bearers shall be two years, but they can be elected continuously for two terms. However, the term of elected office bearers at the Prant and Branch level shall be for one year only, but they can be elected continuously for two terms.
Provided that in specific and emergent cases any sitting office bearer of the branch may be granted exemption by the Prantiya Executive for contesting election at the Branch for one more term and likewise for contesting election by any sitting office bearer for one more term at the Prant level, the Centre may grant exemption in the interest of the efficient and smooth running and functioning of the organisation.
62. Power to remove difficulties
If any difficulty arises in respect of implementation of this Constitution, the National Executive shall have power to remove the difficulties in such manner as it deems fit to ensure the smooth functioning of the organisation and to issue circulars and directions not inconsistent with this constitution.
63. Bharat Vikas Parishad may sue or can be sued in the name of National Secretary General or any other person duly authorised in this behalf.
64. Subject to the provision of the Societies Registration Act of 1860, as applicable to the Union Territory of Delhi, Rules of the Parishad embodied herein may be altered, amended or otherwise modified, by a resolution passed by 2/3rd majority of the eligible members of National Governing Board present for voting.
65. In regard to the interpretation of any Rule or of any Bye-law, the decision of the National Executive shall be final.
